These Terms of Service ("Terms") govern your use of tougemotorsports.com and any purchase from Touge Motorsports LLC ("Touge Motorsports," "we," "us"). By using this site or placing an order, you agree to these Terms, our Shipping Policy, Refund Policy, and Privacy Policy.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

2. Orders and Acceptance

Your order is an offer to buy. We may accept, limit, or cancel any order for any reason, including suspected fraud, supplier stock or discontinuation, or an inability to verify payment or shipping information. If we cancel an order after payment, we will refund the amount charged.

3. Pricing, Typographical, and Listing Errors

We work to keep prices, descriptions, and images accurate, but errors happen. Many listings are supplied by manufacturers and distributors. If a product is listed at an incorrect price or with incorrect information, we may cancel any order for that product, whether before or after it has shipped, and refund the amount paid. If an incorrectly priced item has already shipped, we may contact you to either pay the correct price or return the item at our expense for a full refund. Prices, availability, and shipping rates may change without notice.

4. Payment

Payment is due in full at the time of order. Applicable sales tax is calculated at checkout.

5. Fitment and Product Information

You are responsible for confirming that a part fits your vehicle and suits your application before ordering, using the manufacturer part number and fitment information. We are happy to help — contact us with your chassis, engine, and part number before you buy. Product descriptions, specifications, and images come largely from manufacturers and may change without notice; product images may show optional or non-included items.

6. Off-Road, Racing, and Emissions Notice

Many products we sell are intended for off-road, racing, or competition use only and may not be legal for use on public roads, particularly on emissions-controlled vehicles in California and states that follow California emissions rules. Federal and state laws prohibit removing, disabling, or altering emissions control equipment on vehicles used on public roads. It is solely your responsibility to know and comply with all federal, state, and local laws that apply to the parts you buy and how you use them. We make no representation that any product is street legal or emissions compliant unless the listing explicitly states so (for example, by referencing a CARB Executive Order number). We may ask you to confirm the intended use of a product and may cancel any order we reasonably believe is intended for unlawful use.

7. Installation and Assumption of Risk

Performance parts can change how a vehicle behaves and can cause damage or injury if installed or used improperly. We strongly recommend professional installation and tuning. Installation, tuning, and use are at your own risk. Motorsports activities carry inherent risk of property damage, injury, and death.

8. Warranty

Products are covered only by the manufacturer's warranty, if any. Touge Motorsports makes no warranty of its own, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the extent permitted by law. Manufacturer warranties typically exclude racing or competition use, improper installation, modification, and labor costs. We will help you file a warranty claim with the manufacturer.

9. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from a product or order is limited to the amount you paid for that product. We are not liable for installation or removal labor, towing, vehicle downtime, loss of use, or any indirect, incidental, special, or consequential damages.

10. Site Content

Site content, including text, graphics, and logos, belongs to Touge Motorsports or its suppliers and may not be copied or reused without permission. Manufacturer names and trademarks belong to their respective owners.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Gwinnett County, Georgia.

12. Changes to These Terms

We may update these Terms at any time. The version posted on this page at the time of your order applies to that order.
